Factual funding position
Funding for the Kirkby Stephen development was arranged through Adapt Finance / Afig and provided by Funding 365. The facility was secured by a registered charge in favour of Funding 365 over the development and Maytree Construction Ltd.
During the life of the project, Funding 365 appointed Kempton Carr Croft as LPA Receiver over the charged property. The receivership has since concluded; however, the lender’s charge remains registered against Maytree Construction Ltd pending formal release.
Receivership scope and conclusion
The LPA receivership related specifically to the charged property and the lender’s security. Operational control of the development and all project‑related funds during the receivership period was exercised through the receiver acting on behalf of the lender.
Following completion of the receivership, Kempton Carr Croft confirmed that their appointment had formally concluded and that any ongoing matters, including the status of the charge and lender‑level decisions, fall within the remit of Funding 365 and their appointed representatives.
